I guess it would depend on the local or state laws. If I'm not mistaken, it is legal in some states to record someone's video image without their consent as long as you are NOT recording sound with it. I seem to remember reading about a court case involving that sort of thing here in Florida a couple of years ago.

They could also claim that they're doing it to prevent prostitution or to protect the dancers.
