Another random one - I just like knowing how stuff works.

Do you need some sort of special license to own a pornographic/fetish website?

Can you get away with it as "art" if it isn't pornographic?

Is there any benefit of calling it "art"? - financial or otherwise.

What are the restrictions of owning a fetish/pornographic website?

Is there such a thing as an "Independent" porn/fetish website, or does one have to go through companies such as BHE?

no you do not need a special anything.

porn is not illegal, you can call it what you like.

no benefit of calling it art, SE's don't penalize anymore for the word porn.

no restrictions to owning porn sites, sans 2257 documentation if your shooting nude.

BHE is just a network, of course there are other independent sites.

i don't think there's licensing for ownership, however, some locations may require a certain kind of business license approval and/or certain kind of film insurance if you are creating pornographic material in their city or county. Check with your local ordinances for the most accurate info.

the best benefit is probably to the potential models or the impressions by her boyfriends, husbands, friends, family members, and whatnot, assuming they buy your story.

there are many. SBA loans will not qualify. You have to go through special merchant accounts for credit card processing. There might be local ordinances that prevent you from producing material within X number of feet from a school or church, depending on the city or ordinance. You have to maintain age verification documentation of the models in the pornographic material that you publish.

There is a long list of prejudices and restrictions that the adult industry has been targetted for. I have only named off a few potential restrictions.

if you mean independent from a combined merchant/hosting company then yes, there are many. if you mean independent from merchant accounts, then not as many. BHE is a combined solution. There are many merchants that don't make you host with them. And even more merchants that strictly provide merchant solutions with no hosting options at all. These variations are out there because of the differing levels of needs for smut peddlers.
